I chatted in to activate the phone with my sim card. The agent told me that the device is already activated with another customer. The box was sealed and even had a new SIM card in the box.

I know for a fact that the FCC will have them unlock your phone if you put in a complaint with the FCC. They will contact Metro. Metro will contact you by phone.
